A regulação das plataformas no setor do transporte de passageiros: Uma comparação entre Portugal e a Alemanha

Abstract

As tecnologias têm um poder transformador das nossas sociedades e têm moldado o modo como vivemos as nossas vidas e como acedemos aos novos produtos e serviços que elas proporcionam. No caso do transporte de passageiros que recorre às plataformas digitais, a mudança face ao transporte tradicional foi enorme, mas não isento de polémicas e de efeitos negativos. Para perceber como é que o relacionamento dos diversos atores económicos, políticos e sociais, assim como os produtos dessas relações (o enquadramento institucional) pode influenciar o desenvolvimento deste mercado, em Portugal e na Alemanha, recorre-se à análise da legislação relevante, da bibliografia secundária e dos artigos de comunicação social nos dois países, para entender como é que diferenças regulatórias podem influenciar a operação destas empresas nos dois contextos. Para alcançar tal objetivo, é possível encontrarmos duas direções teóricas diferentes: uma que nos diz que estas relações são importantes e que existem diversos tipos de arranjos institucionais (variedades de capitalismo) e outra que nos diz que as relações não são relevantes e que no final há uma trajetória convergente de liberalização. A atualidade do tema, traz-lhe uma especial relevância na medida em que entender esta problemática pode influenciar a discussão e a operação destas empresas em Portugal e na Alemanha. Deste modo, podemos concluir que tendo em conta o confronto entre a realidade e a teoria para cada país, a diversidade regulatória é uma variável que explica a diferença nos dois países do transporte de passageiros através das plataformas digitais.

Technologies have a transforming power in our societies and have shaped the way we live our lives and how we access the new products and services they provide. In the case of passenger transport using digital platforms, the change from traditional transport was enormous, but not without controversy and negative effects. To understand how the relationship between the various economic, political and social actors, as well as the products of these relationships (the institutional framework) can influence the development of this market, in Portugal and Germany, an analysis of the relevant legislation, the secondary bibliography and media articles in the two countries, to understand how regulatory differences can influence the operation of these companies in the two contexts. To achieve this objective, it is possible to find two different theoretical directions: one that tells us that these relationships are important and that there are distinct types of institutional arrangements (varieties of capitalism) and another that tells us that relationships are not relevant and that in the end there is a convergent trajectory of liberalization. The topicality of the topic brings it a special relevance as far as understanding this issue can influence the discussion and the operation of these companies in Portugal and Germany. Thus, we can conclude that, considering the confrontation between reality and theory for each country, regulatory diversity is a variable that explains the difference in the two countries in passenger transport through digital platforms.
