O território da privacidade: das crianças em acolhimento institucional prolongado

Abstract

Este estudo focaliza-se numa das variáveis do sistema de acolhimento de crianças em perigo - a privacidade. Procurou-se conhecer as representações de crianças e cuidadores sobre o território da privacidade das crianças acolhidas, bem como aceder às suas sugestões para promover o direito à privacidade na esfera de acolhimento. Sabe-se que o Estado e a Sociedade assumem acrescidas responsabilidades na protecção das crianças. A revisão de literatura realizada alude que compreender o que pode causar ou afectar o desenvolvimento da criança acolhida é uma questão de indiscutível importância, considerando que os contextos têm uma influência decisiva no desenvolvimento humano. Sublinha também que a privacidade é um valor universal. O direito internacional e nacional consagram este valor. O quadro teórico sustenta, ainda, que as instituições de acolhimento de crianças apresentam sérias dificuldades em salvaguardar o seu direito à privacidade. Partindo deste pressuposto, identificaram-se sete dimensões a investigar e realizou-se um estudo de tipo descritivo, no âmbito da pesquisa qualitativa. As técnicas de recolha de dados utilizadas foram a discussões de grupo focalizada e a entrevista individual. Foram realizadas nove discussões de grupo focalizadas e duas entrevistas individuais a 45 crianças e cuidadores. A análise de conteúdo deu origem a resultados, que após análise e discussão, indicam que tal como esperado, existem sérias dificuldades por parte do sistema de acolhimento em assegurar a privacidade das crianças que acolhe. Contudo, os próprios participantes do estudo contribuíram com sugestões pertinentes que podem concorrer para a construção de mecanismos reguladores da privacidade das crianças em acolhimento institucional prolongado.

This study is focused on one of the variables of the institutionalization system for children in danger - privacy. It attempts to acknowledge the children’s and the caretakers’ representations of the privacy territory in relation to institutionalized children and it aims to understand their suggestions to promote the right to privacy in that environment. It is recognized that the State and Civil Society take on increasing responsibilities in the field of children protection. The literature revision carried out ascertains that understanding what can have an effect on the development of the sheltered child is a matter of undeniable importance, given the fact that the contexts do have a crucial influence in human development. It also underlines that privacy is a universal value. Both international and national law systems institute this value. The theoretical framework sustains that shelter institutions for children have serious difficulties safeguarding children right to privacy. Given the aforementioned presupposition, seven investigative categories were identified and a descriptive type study was carried out within the scope of the qualitative research. The technical tools used for data collection were the focus group discussion and the individual interview. Nine focus group discussions and two individual interviews were carried out with 45 children and caretakers. The content analyses led to the results that, after further analysis and discussion, suggest that the shelter system reveals serious difficulties in the assurance of children privacy. However, the participants of this study contributed with excellent suggestions to launch mechanisms that safeguard children privacy in the context of institutions.
