Abstract: | É evidente a constatação de que o associativismo foi um importante movimento na sociedade
durante a segunda metade do século XIX. As pesquisas iniciais demonstraram, corroborando uma
ideia já existente, que de entre o movimento associativo, o associativismo mutualista foi aquele
que teve maior implantação na sociedade portuguesa, desencadeando o surgimento de uma nova
organização e instituição de âmbito social, sobretudo marcada pela sua função de carácter
previdencialista. Esta é uma característica que levará a uma adesão significativa por parte das
classes trabalhadoras a este tipo de organização. Depois de se terem constituído como associados,
pagando uma quota, podiam esperar obter apoio em variadas situações. De facto, as organizações
especialmente vocacionadas para o socorro na doença e auxílios pecuniários a indivíduos
incapacitados para o trabalho, temporária ou definitivamente, denominavam-se associações de
socorros mútuos ou montepios. É sobretudo para esta forma de associativismo que os governos
fazem incidir a prática do direito de associação, que procuram regularizar em particular a partir
da Regeneração, através do reconhecimento dos benefícios resultantes da sua atividade. Contudo,
apesar da grande expansão dessas associações ao longo da segunda metade do século XIX, os
governos tardam em criar legislação específica para a sua regulamentação, o que apenas ocorrerá
na última década do século XIX. Até aí, a ação governativa restringiu-se à realização de alguns
projetos de regulamentação e de medidas com intuito de adequar e limitar a atividade aos fins a
que se propunham as associações.
O presente trabalho percorre esta problemática, centrando-se na cidade de Lisboa. Procura
descrever o percurso legislativo relativo ao associativismo durante a segunda metade do século
XIX. Considerando um local onde o movimento associativo mostrou importante atividade, a
cidade de Lisboa, realiza-se o levantamento e localização das associações existentes no final do
século XIX, dando-se ainda uma atenção especial aos casos de associativismo entre cidadãos
estrangeiros, no caso concreto, três associações de cidadãos espanhóis. It is clear that the associative movement was an important movement in society during the second half of the nineteenth century. Early research has shown, confirming an existing idea, that from the associative movement, the mutual association was the one type that had most deployment in the Portuguese society, triggering the emergence of a new social institution and organization, particularly marked by its welfare job. This is something that led to a massive adhesion by the working classes in this type of organization. After signing up as members and paying a share, people could obtain help in various situations. As a matter of fact, organizations especially dedicated to helping sick people and aiding individuals that were unable to work, either temporarily or permanently, were called mutual aid associations or pension funds. It is mainly for this form of association that governments addressed the practice of freedom of association, seeking to regularize it, particularly since the Regeneration period, through the recognition of the benefits resulting from their activity. However, despite the great expansion of these associations over the second half of the nineteenth century, governments were slow in creating legislation for their regulation, which only occurred in the last decade of the nineteenth century. Up to then, the governmental action was restricted to the realization of some regulatory projects and measures with the aim of adapting the associations’ activity and limiting their purposes to the ones that were meant. This research covers these issues, focusing on the city of Lisbon. It tries to describe the legislative process concerning the associative movement during the second half of the nineteenth century. Considering a place where the associative movement showed significant activity, the city of Lisbon, the survey and location of existing associations in the late nineteenth century is carried out. Also, a special attention is given to cases of partnerships between foreign citizens, specifically, three associations of Spanish citizens. |
