Governação e regulação do Mar: Uma análise qualitativa: Caso de estudo: ANTAQ

Abstract

O crescimento económico contemporâneo encontra-se intrinsecamente ligado ao mar uma constatação amplamente reconhecida e indiscutível, na medida em que este é a principal via de realização de negócios para agentes económicos. Desde os primórdios, que as nações têm sido interligadas por este património comum, não apenas pela diversidade de recursos que oferece, mas também pela sua função primordial como rota de trocas comerciais. É neste contexto que nasce a necessidade de os estados regulamentarem e governarem os seus espaços marítimos com base na sua jurisdição. Neste contexto, a presente dissertação tem como objetivo fulcral investigar de que forma a Agência Nacional de transportes Aquaviários (ANTAQ) tem respondido ao paradoxo atual de regular um património de natureza global. O trabalho procura compreender em que medida a autonomia regulatória pode servir como instrumento para assegurar uma governação eficaz capaz de interligar uma eficiência económica, uma competitividade saudável, sustentabilidade ambiental equidade social no ramo marítimo. A análise baseiase numa abordagem metodológica qualitativa, que reúne a revisão literária especializada, realização de entrevistas com especialistas e analise de dados setoriais. A ANTAQ afirmase como uma instituição de referência na sua área de atuação constituindo um exemplo relevante de regulação eficiente com capacidade de respostas no contexto nacional. Este estudo permitiu que fosse possível concluir que o futuro da governação marítima dependera da robustez das instituições, capazes de integrar de forma harmoniosa os objetivos económicos sociais e ambientais.

Contemporary economic growth is intrinsically tied to the sea, a widely recognized and indisputable reality, given that it remains the principal channel through which economic agents conduct business. Since ancient times, nations have been interconnected by this common heritage, not only because of the diversity of resources it offers, but also due to its fundamental role as a route for commercial exchange. Within this context arises the need for states to regulate and govern their maritime spaces under the scope of their jurisdiction. Against this backdrop, the present dissertation has as its core objective to investigate how the National Waterway Transportation Agency (ANTAQ) has responded to the current paradox of regulating a heritage that is global by nature. The study seeks to understand to what extent regulatory autonomy can serve as an instrument to ensure effective governance, one capable of bridging economic efficiency, healthy competitiveness, environmental sustainability, and social equity within the maritime sector. The analysis draws on a qualitative methodological approach, combining a specialized literature review, interviews with experts, and the examination of sectoral data. ANTAQ emerges as a benchmark institution within its field of activity, standing as a relevant example of efficient regulation with proven capacity to respond in the national context. This study further concludes that the future of maritime governance will depend on the strength of robust institutions, capable of harmoniously integrating economic, social, and environmental objectives.
