O lóbi em Portugal: Fatores associados à ausência de regulação

Abstract

A presente dissertação teve como principal objetivo averiguar os fatores responsáveis pela ausência de regulação do lóbi em Portugal. O lóbi representa a atividade através da qual grupos de interesse comunicam com decisores públicos para tentar influenciar a formulação de políticas públicas, e a sua regulação tem vindo a ser debatida como um mecanismo essencial para reforçar a transparência e a integridade do processo legislativo. No entanto, apesar das tendências europeias, de inúmeras recomendações por parte de organizações internacionais para que a atividade seja regulada, e de ter experienciado dois processos legislativos nesse sentido, Portugal continua sem ter uma regulação do lóbi. Este estudo procurou apurar os fatores associados à ausência de regulação do lóbi em Portugal e analisa o período entre 2007 e 2024, revisitando as anteriores tentativas de regulação. Para tal, foi analisada documentação oficial e informação publicada pelos média, bem como realizadas entrevistas a decisores e ex-decisores públicos e profissionais do setor. Foi apurado que a posição das lideranças partidárias e a existência de pressões contra a regulação por parte de advogados e sociedades de advogados são fatores associados à ausência de regulação do lóbi em Portugal.

This dissertation aimed to investigate the factors responsible for the lack of lobbying regulation in Portugal. Lobbying represents the activity through which interest groups communicate with public decision-makers in an attempt to influence the formulation of public policies, and its regulation has been debated as an essential mechanism to strengthen the transparency and integrity of the legislative process. However, despite European trends towards regulation, numerous recommendations from international organizations for the activity to be regulated, and two failed legislative processes, Portugal still has no regulation for lobbying. This study sought to investigate the factors associated with the lack of regulation of lobbying in Portugal and analyzes the period between 2007 and 2024, revisiting previous attempts of regulation. To this end, official documentation and media content were analyzed, and interviews with decision-makers, former decision-makers and professionals from the sector were carried out. It was found that the position of party leaders and the existence of pressure against regulation from lawyers and law firms are factors associated with the lack of regulation of lobbying in Portugal.
