Abstract: | O presente trabalho tem por objetivo analisar a forma como o conceito de local de trabalho é abordado pela legislação, doutrina e jurisprudência portuguesas.
Pretende-se, à semelhança do que sucede com o tempo de trabalho, perceber se o local de trabalho pode ou não ser objeto de flexibilização. Para o efeito, iremos descortinar este conceito, analisando as formas como o mesmo se manifesta no âmbito da relação laboral, bem como o papel do empregador e do trabalhador na definição e gestão deste e qual a relevância deste conceito para o desenvolvimento da atividade laboral.
É ainda objetivo deste estudo entender os mecanismos existentes de flexibilização do local de trabalho e como é que as novas formas de trabalho, cada vez mais presentes, se podem conjugar com uma regulamentação tendencialmente rígida nesta matéria.
No final, esperamos conseguir responder à questão que nos colocámos inicialmente: será a flexibilização do local de trabalho uma utopia ou uma inevitabilidade? The aim of this paper is to analyse how the concept of the workplace is approached in Portuguese legislation, doctrine, and case law. As with working time, the aim is to understand whether or not the concept of workplace can become more flexible. To this end, we will unveil this concept, analysing the ways in which it manifests itself within the employment relationship, as well as the role of the employer and employee in defining and managing it and the relevance of this concept to the development of labour activity. It is also the aim of this study to understand the existing mechanisms for making the workplace more flexible and how new forms of work, which are becoming increasingly more present, can be combined with regulations that tend to be rigid in this area. In the end, we hope to be able to answer the question we initially asked ourselves: is the flexibilization of the workplace and utopia or an inevitability? |
