Direitos humanos das mulheres na Guiné-Bissau: Uma análise da atuação do poder judiciário e das autoridades tradicionais na mediação dos conflitos relacionados aos direitos humanos na Guiné-Bissau

Abstract

O objetivo desta investigação é compreender a atuação do poder judiciário no combate às violações dos Direitos Humanos na República da Guiné-Bissau. Para tal faz análise das condições das mulheres procurando entender a garantia dos seus direitos humanos e as medidas adotadas pelo o Estado e as Autoridades tradicionais. Nesta essência, o Estado deve criar mecanismos necessários que garantem a promoção, defesa e o cumprimento dos direitos humanos das mulheres. Dentre diversas violações sofridas, ressalta-se as mais frequentes como a MGF, violência doméstica, agressão física, assédio sexual etc. A excisão genital cumpre um papel de inclusão social importante em que as mulheres excisadas conseguem participar em várias cerimônias tradicionais e religiosas. Para a erradicação desta prática no território guineense é preciso manter o diálogo entre o Estado e as Autoridades tradicionais. A elaboração deste estudo, foi baseado na metodologia de investigação qualitativa através da revisão da literatura sobre o tema, mas também através da análise de legislação e decisões judiciais. A Constituição e a lei da excisão dão a justiça estatal o poder de defender os direitos humanos das mulheres. Conclui, portanto, que os tribunais guineenses assumem um papel de especial relevância na transformação social e erradicação da prática no país.

The aim of this research is to understand the role of the judiciary in the fight against human rights violations in the Republic of Guinea-Bissau. To this end, it analyzes the conditions of women seeking to understand the guarantee of their human rights and the measures adopted by the State and traditional authorities. In this essence, the State must create necessary mechanisms that guarantee the promotion, defence and fulfilment of the human rights of women. Among the various violations suffered, the most frequent are FGM, domestic violence, physical aggression, sexual harassment, etc. Genital excision plays an important role of social inclusion in which women who have been excised are able to participate in various traditional and religious ceremonies. In order to eradicate this practice on Guinean territory, it is necessary to maintain dialogue between the State and the traditional authorities. The elaboration of this study was based on the methodology of qualitative research through the review of literature on the subject, but also through the analysis of legislation and judicial decisions. The Constitution and the excision law give the state courts the power to uphold the human rights of women. It concludes, therefore, that the Guinean courts assume a role of special relevance in the social transformation and eradication of the practice in the country.
