Contraterrorismo na União Europeia: Os casos de Portugal e Espanha (2004-2020)

Abstract

A presente investigação estuda, de forma comparada, o contraterrorismo em Portugal e Espanha, no contexto da União Europeia entre 2004 e 2020, tendo como objetivo central caracterizar as suas políticas contraterroristas, a nível discursivo e institucional/operacional. Esta tese fundamenta-se no pressuposto de que os estados democráticos elaboram as suas políticas contraterroristas em função de vários fatores, tais como a cultura estratégica (UE); a natureza da ameaça que impende sobre o país; e a capacidade de resposta do estado. Esta tese caracteriza a abordagem geral de Portugal e Espanha no contraterrorismo através dos fatores identificados, salientando as suas semelhanças e diferenças. Argumentamos que, no período em estudo, as políticas contraterroristas em Portugal e Espanha são idênticas a nível discursivo (porque o discurso contraterrorista é condicionado pela cultura estratégica europeia), porém distintas a nível institucional/operacional, em resultado da diferente natureza da ameaça que impende sobre os respetivos territórios; a diferente capacidade de resposta dos estados, bem como de outros fatores como a experiência histórica de cada com o terrorismo. Portugal e Espanha afirmam-se como defensores das regras do Direito Internacional, privilegiando a cooperação multilateral para a prevenção e combate ao terrorismo, sendo parceiros aliados em múltiplos fora. A principal mais-valia desta tese reside na elaboração de um trabalho com uma linha de raciocínio distinta do que já foi realizado, tanto ao nível da argumentação como a nível da sistematização e organização das informações analisadas, representando um contributo importante para a compreensão do contraterrorismo em Portugal e Espanha no contexto da UE.

This thesis analyses the Portuguese and Spanish counterterrorism approaches, taking into account the European Union’s security context between 2004 and 2020. The main purpose of this research is to characterize the counterterrorism approach of Portugal and Spain at the discourse and institutional/operational level. This thesis assumes that democratic states define their counterterrorism policies considering a number of different factors, such as strategic culture (EU); the nature of terrorist threat and state response capability. This thesis characterizes the general approach of Portugal and Spain to counterterrorism, through those three factors, highlighting their similarities and differences. This thesis argues that, within the time frame in study, counterterrorism in Portugal and Spain is identical at the discourse level (because their counterterrorism discourse is influenced by the strategic culture of the EU), but it differs at the institutional/operational level due to differences in the nature of the terrorist threat that each face; their different state response capability and other independent factors as the historical experience with terrorist violence. Portugal and Spain comply with International Law rules and stress the importance of bilateral and multilateral cooperation to counter terrorism, while being close allies in various fora. The main value of this thesis is the fact that it uses a distinct approach from previous works within the counterterrorism field, in terms of the organisation and analysis of the information, and it represents an important contribution to the analysis of counterterrorism in Portugal and Spain, within the European Union context.
