La protección social por dependencia en Portugal. Un estudio de derecho comparado, comunitario europeo e internacional

Abstract

Regarding the matter of long-term care social protection, Portugal is a State subjected to article 34 of the Charter of Fundamental Rights of the European Union, and to article 23 of the European Social Charter. However, Portugal only complies apparently or formally with the above mentioned two provisions, in the matter of long-term care social protection. This is due to the fact that the provisions that rule such matter in the Portuguese social security legal regime are, from one side, one enacted in 1999, which is only a mere updating of the supplement of the pension for permanent disability earned in Europe by severe handicapped, and from another side, a law enacted in 2006, which expands health care (namely with long-term benefits), to dependents that are found under a certain level of income, and not (in contrast to what happens in a number of European countries, also studied in this work) a provision aimed to face the problem of the old-aging of population that affects the Portuguese society nowadays. // Em matéria de protecção social da dependência, Portugal é um Estado abrangido não apenas pelo artigo 34.º da Carta dos Direitos Fundamentais da União Europeia, mas também pelo artigo 23.º da Carta Social Europeia. No entanto, Portugal apenas cumpre aparentemente ou formalmente os dois preceitos legais acima citados, em matéria de protecção social por dependência. Isto deve-se ao facto de que as normas reguladoras do tema no ordenamento português de segurança social são, por um lado, um regime aprovado em 1999, que é simplesmente uma actualização do complemento de pensão por incapacidade permanente ou invalidez que cobram na Europa os grandes inválidos, e por outro lado, uma norma de 2006, que amplia a assistência de saúde (materialmente, com prestações de cuidados continuados), para dependentes que se encontrem abaixo de um determinado nível de rendimentos, mas não (diferentemente do que sucede noutros países europeus, aos quais também se refere este trabalho), uma legislação orientada a fazer frente ao problema do envelhecimento da população em que se encontra a sociedade portuguesa.
