Abstract: | A presente dissertação propõe-se a analisar os principais desafios da fiscalidade digital no
âmbito da tributação direta, com especial importância para o estabelecimento estável.
Neste sentido, será apresentado o caminho até hoje percorrido, dando ênfase à intervenção da
OCDE, de mão dada com o G20, que culminou no projeto BEPS (Base Erosion and Profit
Shifting), bem como as Diretivas propostas pela Comissão Europeia.
Identificadas as dificuldades relacionadas com o objeto de estudo, será analisado um conjunto
de caraterísticas inerentes aos investigadores selecionados na base de dados SCOPUS, através
da metodologia PRISMA, bem como o conteúdo dos seus artigos publicados.
Os resultados apresentados confirmam que, perante a realidade de uma nova era digital, é uma
temática que tem conquistado popularidade por parte da comunidade cientifica e que exclama
pela urgência da implementação de um sistema fiscal harmonizado, mais justo e eficiente que
ponha um travão a medidas unilaterais entre Estados e que vá de encontro ao bom
funcionamento de um mercado comum, que é a base do conceito do Mercado Único Digital. This Master's thesis proposes to analyze the main challenges of digital taxation in the field of direct taxation, with emphasis for permanent establishment. This work will show the path taken so far, emphasizing the OECD intervention, hand in hand with the G20, which culminated in the BEPS (Base Erosion and Profit Shifting) project, as the Directives proposed by the European Commission as well. After identifying the difficulties related to the subject, following the PRISMA methodology, the characteristics of the researchers selected in SCOPUS and their published articles will be analyzed. In this new digital era, the results presented confirm that this subject has gained popularity in the scientific community. There is also an urgent need for implementation of a harmonized, fairer and more efficient tax system that will put a brake on unilateral measures between States, and finally, a functional common market, which is the basis of the Digital Single Market. |
