Resumo: | O estudo das convenções coletivas de trabalho, como fontes específicas do direito laboral,
assume grande importância e centralidade. Determinar o início e o tempo da sua vigência é
fundamental no seio das relações coletivas e individuais de trabalho. Definir o momento da
sua morte, da cessação dos seus efeitos, não é matéria de somenos importância. Verificar se
essa morte é ou não conforme com o disposto na lei fundamental do estado, a Constituição da
República Portuguesa, é discussão necessária e com toda a atualidade e pertinência.
Na presente dissertação propomo-nos a analisar, à luz da legislação em vigor, os meandros da
vigência das convenções coletivas, o momento do seu início, as possibilidades da sua
duração, assim como importância da autonomia coletiva das partes em todos estes momentos.
Propomo-nos, também, a analisar os instituo a que a lei conferiu a honra de ser o último
suspiro da convenção, abordando a denúncia, os prazos de sobrevigência, as recentes
"inovações" legislativas da Lei n.º 93/2019 de 4 de Setembro.
No final abordamos a questão da caducidade, introduzida com o Código do Trabalho de 2003,
a sua desconformidade com os preceitos constitucionais dimanados da Constituição de 76 e a
crise social e o estado de necessidade em que os trabalhadores são colocados devido a esta
opção, tremendamente errada, do legislador. Analisaremos também, a problemática, que
divide atualmente associações patronais e sindicais e as coloca em campos opostos, da
natureza constitutiva ou declarativa do aviso de cessação de vigência, decantando-nos,
claramente, pela primeira opção. The study of work collective agreements as sources of labour law, takes a great deal of importance and centrality. Determining the lenght of its validity is fundamental within the matters of collective and individual work relations. To define the moment of its death, the cease of its effects, is not a matter of lesser importance. Verifying if that death is wether or not compliyng with what is displayed on the fundamental law of the state, The Constitution of the Portuguese Republic, is a needed and relevant discussion. In the present thesis we propose ourselves to analyze, under the light of current law, the intricacies of the validity of collective agreements, the moment of its start, the odds of its duration, just like the importance of the colective autonomy of the different parties in all of its moments. We also propose ourselves to analyze the legal schemes that the law has bestowed the honour of being the last breath of the collective agreement, aproaching the arraingnment, the terms of overlapping validity, the recent legal "inovations" of the Law number 93/2019 from September the 4th. In the end we aproach the issue of decrepitude, introduced in the Labour Code of 2003, its nonconformity with the constitutional precepts which spawned from the 1976 Constitution and the social crisis and state of need that workers have been into due to this, tremendously wrong, legislator ruling. We are also going to analyze the issues that lately have been dividing employer associations and unions, putting them into opposing sides, of the constitutive or declarative nature of the validity cessation notice, making is clearly choose the first option. |
