Abstract: | Ao longo do tempo, as tecnologias de informação e comunicação evoluíram e adentraram na forma de viver da sociedade, assim como na organização e duração do trabalho. Os computadores e telefones inteligentes que permitem ultrapassar as barreiras do tempo e lugar, conectam as pessoas em qualquer hora e em qualquer lugar do mundo. Diante dessa hiperconectividade e disponibilidade, voluntária ou não, a presente dissertação visa explorar o conceito surgido no ordenamento jurídico francês, do direito à desconexão do trabalhador, apresentando sua definição e seus fundamentos, além de identificar a situação atual que se desenvolve o assunto. Como objetivos específicos, buscou analisar comparativamente o direito à desconexão no setor bancário, no Brasil e em Portugal, percebendo se os resultados dialogam com as referências postuladas no enquadramento teórico e se há divergência ou convergência em relação aos trabalhadores brasileiros e portugueses no que diz respeito a essa problemática. Over time, information and communication technologies have evolved and penetrated society's way of living, as well as the organization and duration of work. Computers and smart phones allow you to overcome the barriers of time and place, connecting people anytime, anywhere in the world. Faced with this hyperconnectivity and willingness, whether voluntary or not, this dissertation aims to explore the concept of the French legal system, the right to disconnect of employee, presenting its definition and its foundations, and identify the current situation that develops the subject. As specific programmers, comparatively sought the right of disconnection in the banking sector, in Brazil and Portugal, perceiving the results based on references postulated in the theoretical framework and whether divergence or convergence in relation to the Brazilian and Portuguese workers with regard to this one type of problem. |
