A flexigurança aplicada às microempresas: visão critica sobre o direito do Trabalho quando aplicado à realidade portuguesa

Abstract

A feitura de qualquer obra, literária, científica ou outra ( e também a deste humilde ensaio) , não necessita de qualquer justificação especial. Para que nasça, é bastante a vontade legítima de criar ou de testemunhar algo. Contudo, a essa vontade aliam-se, por vezes, circunstâncias acidentais e inesperadas que a transformam num projecto concreto e tornam, para o autor, urgente essa tarefa. O tema que se pretende abordar relaciona-se com um outro já bastante debatido, a flexigurança, mas propondo, agora, a sua aplicação, ao nível das microempresas, tema que, desta perspectiva, não goza de qualquer abordagem, pelo menos por entidades públicas. Abordar-se-à o problema de um direito laboral que, pensado para ser aplicado indiferentemente a qualquer tipo de empregador ou empresa, corre o risco de gerar desequílibrios que, na prática geram injustiça social. Referimo-nos, evidentemente, àquela “empresa” constituída apenas pelo seu próprio e único fundador, – a microempresa. Faz-se referência, igualmente, às características da relação laboral no seio de uma microempresa. Focaremos ainda a necessidade urgente de dimensionar o direito do trabalho, sem com isso promover a desigualdade. Caracteriza-se a flexibilização, quer interna quer externa, ao nível das microempresas. Por fim falamos da necessidade de pensar a flexibilização, não de uma forma pura e dura, mas sustentada por uma vertente de segurança efectiva. Ou seja, é fundamental facilitar a actuação, a gestão do empregador, da microempresa, mas sem esquecer a protecção que merece quem nelas trabalha.
