O direito oficial e o direito costumeiro no estado colonial: o caso de Moçambique

Abstract

Este trabalho insere-se no quadro da ciência jurídica e tem por objecto a análise da dimensão jurídica da dominação colonial portuguesa em Moçambique e da sua eficácia prática ou não. O nosso objectivo consiste em analisar os efeitos das várias tentativas de codificação que se fizeram, procurando, nomeadamente, saber em que medida essas tentativas espelhavam os usos e costumes indígenas, estabelecer os pontos de «permanência» e as «rupturas» introduzidas pelo esforço legislativo do colonizador em relação às ordens jurídicas tradicionais, tentando assim contribuir para a análise da dimensão jurídica da doutrina colonial portuguesa e fazer um levantamento dos estudos de diversos autores e das sucessivas tentativas de codificação dos direitos indígenas em Moçambique.

This paper is integrated in the framework of legal science and its objective is the analysis of the legal dimension of the Portuguese colonial rule in Mozambique as well as its practical impact. Our aim consists of the analysis of the effects of the different attempts of codification and how these reflected the indigenous traditional legal values and practices. This paper also includes the analysis of how the legislative effort of the former colonizing power represents a perspective of «permanence» or «rupture» considering the traditional jurisprudence. The final objective is to contribute to the analysis of the legal dimension of the Portuguese colonial doctrine and to collect the main studies of different authors and the successive attempts of codification of indigenous law in Mozambique.
