O papel das comissões municipais de proteção às pessoas idosas

Abstract

O estudo que se apresenta pretende mostrar o contributo específico das Comissões Municipais de Proteção à Pessoa Idosa criadas a nível municipal. Através de uma metodologia qualitativa, de abordagem indutiva, foi realizada análise documental e legislativa, seguida da análise de conteúdo categorial, para a análise e interpretação dos dados recolhidos. Foram efetuadas entrevistas a Assistentes Sociais de três Comissões de Proteção e, da sua análise bem como da análise aos regulamentos das Comissões, considera-se que estas não acrescentam contributo em matéria de proteção, para além da que decorre de um modelo de funcionamento que institucionaliza, num território, a concertação da intervenção social direcionada para as pessoas idosas. Contrariamente ao que acontece com a proteção das crianças que exige legislação própria pela sua incapacidade jurídica para decidir autonomamente, a proteção das pessoas com mais idade não requer uma entidade própria pois, como cidadãos adultos, têm capacidade de decisão e a sua proteção enquadra-se no direito nacional, nas liberdades e garantias que assegura, isto é, qualquer ação contra elas enquadra-se na legislação geral, sendo dever de qualquer cidadão ou entidade denunciar as situações que atentem contra a sua dignidade. Considera-se que a designação “Comissão Proteção de Pessoas Idosas”, por si só, estigmatiza este grupo etário, um grupo muito heterógeno cuja proteção nas suas fragilidades passa, essencialmente, pela existência de políticas de rendimento, de estruturas de apoio social adequadas às diferentes necessidades da população e em que lhe sejam garantidos os direitos e liberdades inerentes a um cidadão adulto.

The present study aims to show the specific input of the Municipal Commissions of the Elderly Protection created at a municipal level. Through a qualitative methodology, of inductive approach, a documental and legislative analysis was performed, followed by a categorical content analysis, for further analysis and data interpretation. Interviews with Social Workers from three Protection Commissions were accomplished and, from its analysis and the analysis of the regulations from the Commissions, it’s considered that these Commissions don’t any contribution on the protection themes, and, in addition, this protection runs based on a working model that institutionalizes, on a territory, the concertation of social intervention directed to the elderly people. Contrary to what occurs in the children protection, that demands its own laws because of its juridical incapacity of deciding independently, the elderly protection doesn’t require its own entity because, as adult citizens, they have the capacity of choosing and their protection fits on the national rights, in the liberties and guarantees that ensures, meaning any actions against them fits in the general legislation, being the duty of any citizen or entity to report situations that go against their dignity. It’s considered that the “Protection Commission of Elderly People”, on its own, stigmatizes this age group, a very heterogeneous group whose protection of their weaknesses passes, essentially, by the existence of income politics, with social support structures suited for the different population needs and that are granted the rights and liberties inherent of an adult citizen.
