Conflitualidade social e regulação do tempo de trabalho

Abstract

O estudo procura assinalar as especificidades da evolução do tempo de trabalho em Portugal, identificando os factores que influenciaram a sua regulação. De um ponto de vista histórico, examina a questão à luz das diversas conjunturas políticas e económicas que marcaram os séculos XIX e XX em Portugal. Procede, igualmente, a uma análise em que compara as condições de trabalho em Portugal durante o processo de industrialização com as vigentes noutros países onde a industrialização foi mais precoce e mais dinâmica, evidenciando as especificidades do caso português mas também o cenário comum de longas jornadas de trabalho. O estudo analisa com maior pormenor o período subsequente a 25 de Abril de 1974, demonstrando que a duração do tempo de trabalho não foi significativamente afectada pelo processo de reivindicações e conquistas imediatamente após a Revolução. É, apenas, no quadro da concertação social e já num período de estabilização política e constitucional que se registam os maiores avanços no sentido da diminuição do tempo de trabalho. Os princípios estruturantes do Código do Trabalho de 2003 e da reforma actualmente em curso são passados em revista, tentando detectar nesses princípios estruturantes a emergência de um paradigma futuro nos usos e na gestão dos tempos, bem como o afloramento de novos mecanismos de representação de interesses e uma lógica de conflitualidade social mais diferenciada do que a que caracterizava o paradigma típico da sociedade industrial. A presente dissertação inclui, em anexo, um estudo empírico sobre a redução para as 40 horas semanais.

The study aims to point out the specifics of the evolution of working time duration in Portugal, identifying the factors that have influenced its regulation. From an historical point of view it examines the subject according to the most determinant political and economical factors that influenced the XIX and XX centuries in Portugal. It also carries an analysis where labour conditions in Portugal during the industrialization process are compared to the ones that took place in other countries, where industrialization occurred earlier and in a more dynamic form, evidencing the specifics of the Portuguese case as well as the common scenario of long working hours. The study analyses more detailly the period subsequent to the 25th of April 1974, showing that the working hours’ duration has not been significantly affected by the entitlement and conquest process that immediately succeeded the Revolution. Major improvements regarding the working hours’ reduction occurred only within the scope of social coordination and in a period of political and constitutional stabilisation. The structuring principles of the 2003 Labour Code and of the current Reform are reviewed in the attempt to identify, in such principles, the emergence of a future paradigm in the time use and time management. At last, it detects the rising of new mechanisms of representation of interests and a more differentiated logic of social conflict than the one that characterised the typical paradigm of the industrial society. The present dissertation includes, as an attachment, an empirical study on the reduction to the 40 hour working week.
