Declaração de Insolvência: das garantias dos créditos laborais e dos efeitos na esfera jurídica do trabalhador

Abstract

A presente dissertação tem como objectivo primordial analisar a Declaração de Insolvência, pretendendo centrar o seu estudo nas garantias dos créditos laborais e nos efeitos na esfera jurídica do trabalhador. Partindo do enquadramento constitucional do tema, em particular dos direitos fundamentais dos Trabalhadores, procurámos corroborar a sua materialização nos vários aspectos em que subdividimos a questão em análise. Verificámos, enquanto aprofundámos a declaração judicial de insolvência, o contrato de trabalho no âmbito da mesma e a tutela dos créditos laborais, que a realidade desdobra em múltiplos problemas concretos, o que muitas vezes se traduz em novas questões num tema que se demonstra trabalhoso e bastante abrangente. Interessante foi também notar que, além de esta ser uma questão de claro interesse teórico, a sua aplicação prática é inesgotável, tal é a actualidade do mesmo. Aliás, cremos que o facto de alguns indicadores económicos demonstrarem que pode Portugal estar à beira do fim da actual crise económica, em nada retirará interesse à presente questão, acreditando nós que irão surgir novas contendas no âmbito das empresas em situação de insolvência/dificuldades acrescidas e, consequentemente, na esfera jurídica dos seus trabalhadores. Os múltiplos desdobramentos da declaração de insolvência, analisada no âmbito das garantias dos créditos laborais e dos efeitos na esfera jurídica do trabalhador, relevam para o interesse da discussão do tema em crise. Nesta conformidade, a presente dissertação mais não pretende ser do que uma aproximação ao que de concreto existe no panorama legal português, estudo essencial para a compreensão da sua aplicação prática e, quiçá, para um melhor planeamento jurídico no âmbito do Direito Empresarial.

This thesis aims to analyse the Declaration of Insolvency by focusing on the work credit guarantees and its legal effects on the workers. Based on the constitutional framework of this subject, in particular case, the Fundamental Rights of the Workers, we wanted to underline its implementation in the various aspects in which the subject under analysis has been subdivided. While thoroughly examining the declaration of insolvency, the employment contract within its scope, as well as, the protection of work credits, we came to the conclusion that the reality translates into a variety of specific problems, which quite often raise new issues within the broad and hard subject we have elaborated on. It was interesting to realise that the practical application of this subject, which clearly has a great theoretical value, is limitless, due to its high relevance. Actually, we think that the fact that some economic indicators show that Portugal is apparently coming out of its current economic crisis, does not diminish at all the relevance of this subject. We strongly believe, that a range of new issues will emerge in the context of companies going bankrupt or undergoing serious difficulties and, consequently, will legally affect their workers. The multiple facets of the declaration of insolvency, which was analysed taking into consideration the work credit guarantees and the legal impact on the workers, show the paramount importance of this subject. In this regard, this thesis is intended to be an approach to what actually exists in the Portuguese legal scope, a crucial study to further understand its practical application and, perhaps, to further improve the legal framework in Business Law.
