Parcerias público-privadas no sector rodoviário: análise de caso

Abstract

Actualmente, Portugal é um dos países do mundo com maior extensão relativa de auto-estradas. Esta situação decorre das opções políticas que foram tomadas desde a década de noventa, que apostaram fortemente no investimento em infra-estruturas rodoviárias. Estes investimentos foram, na maioria dos casos, realizados em regime de Parcerias Público-Privadas (PPP) envolvendo, assim, investidores privados num objectivo considerado nacional. Note-se que 80% dos valores investidos em PPP dizem respeito a projectos rodoviários. Projectos estes financiados com recurso ao Project Finance, forma de financiamento preferida para projectos de infra-estruturas de grande dimensão. Diversos estudos enfatizaram a importância critica da relação entre investimento em infra-estruturas e crescimento económico. Contudo, nos últimos anos, alguns episódios de instabilidade financeira e o insucesso de alguns projectos de investimento fizeram com que se voltasse a reflectir nos riscos envolvidos no Project Finance. Assim, vinte anos depois, chegou a altura de repensar todo o sector. As necessidades de financiamento desses projectos de infra-estrutura rodoviária e a actual conjuntura económica forçam a que sejam efectuadas alterações significativas na política de investimentos. A conjuntura mudou e os objectivos nacionais também. Este trabalho propõe-se precisamente a analisar este Caso Pedagógico. Ou seja, quais os principais projectos rodoviários em Parceria Publico-Privada lançados em Portugal, quais as principais alterações legislativas neste sector, como se estrutura um Project Finance no âmbito das Concessões Rodoviárias e, por último, como se avalia uma Concessão Rodoviária.

Nowadays Portugal is one of the countries in the world with a wider extension of motorways, in relative terms. This situation is the result of political options that were taken since the nineties, which settled motorway infrastructure’s investment as a priority. Those investments were in most of the cases Public-Private Partnerships (PPP), which brought private sponsors to a national aim. You must take notice that 80% of the amounts invested in PPP refer to projects in motorways. Those Projects were financed by Project Finance, the preferred form of financing large-scale infrastructure projects. Several studies have emphasized its critical importance, focusing on the link between infrastructure investment and economic growth. However, over the last few years, episodes of financial turmoil and the financial failure of several high-profile projects have led many to reflect on the risks involved in Project Finance. On this context, twenty years after, it’s time to rethink everything about this sector. Financing needs of motorway infrastructure projects and the actual economic environment force to significant changes in investment politics. The economic context has changed as well as the national goals. This work proposes to analyze this Case Study. Therefore, what are the principal motorway projects in Public-Private Partnership done in Portugal, what are the principal law changes in this sector, how can we structure a Project Finance in a Motorway Concessions and, at the end, how we can valuate a Motorway Concession.
