As universidades fundacionais e o New Public Management

Abstract

Desde os finais dos anos 70, os Estados têm implementado reformas na Administração Pública que alteraram o paradigma da prestação dos serviços e da relação das estruturas administrativas com os cidadãos. Esse conjunto de reformas foi designado New Public Management e foi marcado pela privatização de funções do Estado, com os governos a abdicarem das operações e serviços que podem ser melhor geridos por empresas privadas ou por agências públicas de matriz empresarial, pela descentralização de tarefas, pela introdução de uma cultura empresarial e por um aumento do necessidade de prestação de contas e demonstração de resultados. Esta dissertação analisa a forma como o New Public Management se concretizou no ensino superior e que influências teve no modelo de governação das universidades e institutos politécnicos. A dissertação analisa ainda a importância da autonomia institucional no ensino superior e os regimes legais criados que a possam favorecer, nomeadamente realçando o modelo de independent legal status. Em Portugal, esse modelo foi implementado através da criação das universidades fundacionais e esta dissertação concluirá que estas universidades passaram a evidenciar caraterísticas manageriais mais aprofundadas após a sua adesão ao regime fundacional.

Since the late seventies, Governments have implemented several reforms in public administration that have changed the paradigm of public service delivery and the organization of administrative bodies in their relation with citizens. This set of reforms was called New Public Management and it is characterized by the privatization of public services, with governments giving up the operations and services that can be better managed by private companies or public agencies, the decentralization of tasks, the introduction of an entrepreneurial culture and an increased need for accountability and demonstration of results. This thesis examines how the New Public Management was implemented in higher education and how it influenced the governance of universities and polytechnics. The thesis also examines the importance of institutional autonomy in higher education and the legal regimes designed to promote it, and in particular highlighting the model of "independent legal status." In Portugal, this model was implemented through the creation of University Foundations and we conclude that these universities began to show more managerial characteristics after their accession to the foundational model.
