Regulação da saúde suplementar no Brasil

Abstract

A presente investigação tem por objetivo abordar a regulação da Saúde Suplementar no Brasil, enfocando o papel desempenhado pela Agência Nacional de Saúde (ANS). Foi efetuado um estudo retrospectivo de a Saúde Suplementar no Brasil, cobrindo vários aspectos, a saber: a Saúde Suplementar anterior à Lei 9656/1998; os pontos positivos e negativos da referida Lei; a criação da Agência Nacional de Saúde bem como a forma como tal agência efetua a regulação da saúde no Brasil. Posteriormente, foi realizado um estudo comparativo entre a forma de regulação adotada pela ANS e a forma praticada na área de saúde em outros países. Também, foram apresentadas sugestões para o aperfeiçoamento do papel regulatório da Agência Nacional de Saúde. Justifica-se a pesquisa pelo fato de a assistência à saúde, a sua gestão e regulação serem de grande importância para o bem estar da população. Neste cenário, observamos que os conflitos entre os diversos atores, operadoras, clientes/utentes e hospitais levam à necessidade de uma regulamentação que estabeleça limites e defina responsabilidades, bem como à criação de um órgão fiscalizador, seja uma Agência Reguladora ou o próprio Ministério da Saúde. A ANS vem, desde a sua criação, promovendo uma diminuição sistemática de operadoras, seja por fusão, seja por fechamento devido à dificuldade em adaptar-se à imensa quantidade de normas reguladoras editadas, conforme demonstrado ao longo da realização deste estudo. Em virtude do exposto, podemos inferir que a ANS não conseguiu manter a independência e a equidistância necessárias aos propósitos de uma agência reguladora, sendo nítida a influência dos políticos na nomeação e na atuação das ANS.

The objective of the present investigation is to approach the regulation of the Supplementary Health in Brazil, focusing in the role played by the Health National Agency (ANS). A former study on the Supplementary Health in Brazil was carried out, covering various aspects: Supplementary Health in Brazil before the 9656/1998 Law; the positive and negative points of the mentioned Law; the creation of the Health National Agency as well as the way such agency performs the regulation of health in Brazil. Afterwards, a study was carried out comparing the way of regulation adopted by ANS to the way of regulation practiced in other countries. Also, suggestions aiming the improvement of the regulatory role of the Health National Agency were presented. This research is justified owing to the fact that health assistance, its management and its regulation are considered of great importance to the welfare of the population. In this scenery, it has been noticed that the conflicts among the different actors, agencies, clients/users and hospitals reveal the necessity of a regulation which establishes limits and define responsibilities, as well as the creation of a controlling institution, which may either be a Regulation Agency or the Ministry of Health itself. Since its opening, the ANS has been promoting a systematic decrease of agencies, due to either their fusion or their closing because of the difficulty in adapting to the enormous amount of edited regulating norms, as it has been shown in this investigation. Hence, it may be inferred that the ANS has not managed to maintain the independence and equidistance necessary to the purposes of a regulating agency, being visible the influence of politicians in the appointment and performance of the ANS.
