O direito de intervenção humanitária: o Genocídio na Bósnia e no Ruanda

Abstract

Em pleno século XXI, as violações graves dos direitos humanos, em particular as que são realizadas por quem os devia proteger, não podem ainda ser consideradas como motivo consensual que justifique e legitime uma intervenção militar. Mas, neste caso, quando os estados falham na protecção dos direitos fundamentais das suas populações, ou se são, eles próprios, responsáveis por estas violações, o que deve a sociedade internacional fazer? Devem estes estados manter a plenitude dos seus direitos, nomeadamente, o seu direito à inviolabilidade da soberania territorial? Que mensagem passa a sociedade internacional ao manter a impunidade de quem pratica tais actos e ao nada fazer para lhes pôr fim? Na década de 1990, num espaço de apenas dois anos, o mundo assistiu impávido ao massacre de milhares de seres humanos, um número que, no Ruanda, rondou a ordem dos milhões de mortos. Em ambos os casos foram os respectivos aparelhos estatais e governativos os responsáveis pelo genocídio e em ambos os casos os ataques às minorias alvo foram premeditados e bem planeados. Em ambos os casos os observadores internacionais tinham o conhecimento prévio destas intenções. Para que casos como estes não se repitam, é necessário uma alteração de paradigma que coloque os direitos humanos no centro das relações internacionais; esta investigação propõe-se precisamente a contribuir para essa alteração. É ainda objectivo central definir os princípios orientadores da intervenção humanitária e estabelecer a legitimidade deste tipo de intervenção nas relações internacionais.

In the XXI century, serious violations of human rights, particularly committed by those who have the duty to protect them, cannot yet be considered as a consensual reason that justifies and legitimizes military intervention. However, in this case, when states fail to protect fundamental rights of their populations, or are themselves responsible for these violations, what should the international society do? Must these states maintain their full international rights, including the right to non-violation of their territorial sovereignty? What kind of message is the international society sending when contributes to maintain the impunity of those who practice such acts or does not do anything to stop them? In the 1990s, in just a couple of years, the world passively watched to the massacre of thousands of human beings, a number that in Rwanda was close to a million. In both cases, the responsible for the genocide lie in the state and in the governmental structure, and in both cases the attacks were premeditated and well planned to target specific minorities. Furthermore, in both cases the international observers had prior knowledge of these intentions. In order for these cases not to happen again, it takes a profound shift of paradigm and human rights have to be at the heart of international relations. This investigation is intended to contribute to this change, and its main objective is to define the guiding principles of humanitarian intervention, as well as establishing the legitimacy of this type of intervention in international relations.
