A eficacia das medidas de trabalho comunitário: Impactos e desafios na Reinserção Social

Abstract

O presente trabalho de projeto tem como objetivo analisar, no âmbito da medida de Trabalho a Favor da Comunidade, de que forma é entendido o compromisso legal que esta estabelece em relação à reprovação do ato ilícito e à reparação perante a sociedade. A investigação baseia-se nas perspetivas dos diferentes agentes do sistema de justiça envolvidos na sua execução. Durante o estágio realizado na Equipa Lisboa Trabalho Comunitário da Direção-Geral de Reinserção e Serviços Prisionais, foi possível contactar diversos intervenientes, nomeadamente entidades beneficiárias do trabalho, prestadores da medida e técnicos superiores de reinserção social. O objetivo principal consistiu em compreender como estes agentes percecionam a eficácia da medida e se os seus objetivos são efetivamente alcançados. A investigação, de natureza qualitativa e exploratória, recorreu à metodologia de investigação participante, com técnicas como observação direta e entrevistas presenciais. Os dados recolhidos revelam que, embora exista alguma incerteza quanto à interiorização da medida por parte dos prestadores, os técnicos e as entidades beneficiárias reconhecem o Trabalho a Favor da Comunidade como uma medida com valor reparador e reprovador. Conclui-se que, de forma geral, o Trabalho a Favor da Comunidade cumpre os seus propósitos, sendo essencial o envolvimento ativo de todos os agentes na sua aplicação para garantir a eficácia e preservar o seu significado. Foram também identificadas fragilidades que poderão ser alvo de propostas de melhoria futura.

This project aims to analyze how the legal commitment established by the measure of Community Service Work is understood in terms of both censure and reparation, based on the perspectives of various justice system agents involved in its implementation. During an internship with the Lisbon Community Work Team at the Directorate-General for Reintegration and Prison Services, contact was made with several stakeholders, namely beneficiary entities, community service workers, and senior reintegration officers. The main objective was to understand how these agents perceive the effectiveness of the measure and whether its intended goals are actually achieved. This qualitative and exploratory research was based on a participant observation methodology, using direct observation, in-person interviews, and other data collection techniques. The findings reveal that, although there is some uncertainty regarding the internalization of the measure by the individuals sentenced to it, both the reintegration officers and the beneficiary entities recognize Community Service Work as a measure with genuine reparative value for society and censure of the offense committed. Overall, the measure appears to fulfill its intended purposes. However, the active involvement of all agents in its application and execution is considered essential to ensure its effectiveness and prevent it from losing its intended meaning. The study also identifies several weaknesses in the implementation process, which may serve as a basis for future proposals aimed at improving the measure.
