Os reflexos da doença no contrato de trabalho

Abstract

Nesta nossa dissertação procurámos evidenciar, por forma lógica e estruturada, o tratamento que o Direito português confere às consequências das situações doentias que afetam os trabalhadores nos tempos presentes em que a inteligência artificial começa a imperar. Ao contrário do que tem acontecido, procurámos ir mais longe do que a simples e tradicional justificação das faltas ao trabalho por motivo de doença. Encetámos o nosso trabalho por evidenciar o tratamento que o Direito positivo vai dando às consequências das diferentes doenças que resultam da prestação do trabalho e do relacionamento que dele emerge, quer com colegas, quer com superiores hierárquicos, quer com os subordinados, não esquecendo o meio físico e ambiental. Procurámos também evidenciar as repercussões de natureza jurídica no emprego que resultam da doença dos familiares dos trabalhadores, nomeadamente, das crianças e dos idosos. Nos dois últimos capítulos, numa visão clássica e tradicional, realçamos o papel do Direito ao regular as consequências resultantes das doenças profissionais e dos acidentes de trabalho, procurando ainda apresentar, em resenha, os regimes jurídicos da prevenção e da reabilitação.

In this dissertation we sought to highlight, in a logical and structured way, the treatment that Portuguese Law gives to the consequences of unhealthy situations that affect workers in the present times in which artificial intelligence begins to prevail. . Contrary to what has been happening, we tried to go further than the simple and traditional justification for absences from work due to illness. We began our work by highlighting the treatment that positive Law gives to the consequences of different illnesses that result from the provision of work and the relationships that emerge from it, whether with colleagues, hierarchical superiors, or subordinates, not forgetting the environment physical and environmental. We also sought to highlight the legal repercussions on employment that result from the illness of workers' families, particularly children and the elderly. In the last two chapters, in a classic and traditional view, we highlight the role of Law in regulating the consequences resulting from occupational diseases and accidents at work, also seeking to present, in review, the legal regimes of prevention and rehabilitation.
