Resumo: | A contratação coletiva é um instrumento fundamental na regulação das relações laborais. Prevista na
Constituição da República, adquire uma centralidade bem estabelecida enquanto fonte de direito
laboral e elemento estruturante das relações coletivas de trabalho.
Assentando na liberdade sindical e no direito à ação coletiva, manifesta-se em diferentes tipos de
instrumentos de regulamentação coletiva do trabalho, entre eles, o contrato coletivo de trabalho,
acordo estabelecido entre associações de empregadores e de trabalhadores.
Embora confrontada com diversos desafios, de diversa natureza, a contratação coletiva ainda é o
instrumento por excelência ao alcance dos trabalhadores para, através dos sindicatos que os
representam, atingirem os seus objetivos que tanto podem ser de ordem remuneratória, como de
definição e revisão de carreiras ou ainda de proteção no emprego, entre outros, que de forma
individual tornar-se-ia mais difícil de alcançar. Para as empreses é também um mecanismo de
estabelecimento de regras de concorrência, nomeadamente, quanto a questões salariais e objetivos
de paz social.
Com o presente trabalho focamo-nos no estudo dos contratos coletivos produzidos num setor de
atividade em particular, a Grande Distribuição, e em concreto os negociados pela APED, enquanto
associação de empresas daquele setor e a FEPCES, federação de sindicatos que com aquela negoceia.
Partimos de uma hipótese traduzida na obtenção de ganhos pelas partes contratantes, de um lado
os patrões e a sua potencial tentativa flexibilizadora das relações laborais e, do outro lado, como os
sindicatos contrariam esse objetivo, garantindo ganhos para os seus representados. É a partir da
análise e leitura longitudinal do clausulado dos contratos coletivos negociados pelos atores referidos
e complementado com dados obtidos por entrevista que confirmaremos ou inferiremos aquela
hipótese. Collective bargaining is a fundamental instrument in the regulation of labor relations. Provided in the Constitution of the Republic, it acquires a well-established centrality as a source of labor law and a structuring element of collective labor relations. Based on freedom of association and the right to collective action, it manifests itself in different types of collective labor regulation instruments, including the collective bargaining agreement, an agreement established between employers and workers associations. Although faced with several challenges of different nature, collective bargaining is still the instrument par excellence within the reach of workers, through the unions that represent them, to achieve their objectives, which can be of a remuneration nature, as well as of definition and review of careers or employment protection, among others, which individually would become more difficult to achieve. For companies, it is also a mechanism for establishing competition rules, namely regarding salary issues and social peace objectives. With the present work we focus on the study of collective contracts produced in a particular sector of activity, the Large Distribution, and specifically those negotiated by APED, as an association of companies in that sector and FEPCES, a federation of unions that negotiates with that sector. We start from a hypothesis translated into the achievement of gains by the contracting parties, on the one hand, the bosses and their potential attempt to make labor relations more flexible and, on the other hand, how the unions contradict this objective, guaranteeing gains for their represented. It is from the analysis and longitudinal reading of the clauses of the collective contracts negotiated by the mentioned actors and complemented with data obtained by interview that we will confirm or infer that hypothesis. |
