Resumo: A presente dissertação de mestrado dirige-se, nos planos europeu e nacional, à regulação de serviços públicos de infra-estruturas, bem como à regulação transversal. Neste âmbito, são caracterizados os sectores da água e dos resíduos, do transporte ferroviário, das telecomunicações/comunicações electrónicas e da energia, enquanto objecto de regulação sectorial. O Instituto Regulador de Águas e Resíduos (I.R.A.R.) e o recém criado Instituto da Mobilidade e dos Transportes Terrestres, I.P. (I.M.T.T.,I.P.), que integra a Unidade de Regulação Ferroviária (U.R.F.), são naturalmente analisados, estudo que se estende à Autoridade Nacional de Comunicações (I.C.P.-ANACOM) e à Entidade Reguladora do Sector da Energia (E.R.S.E.). No plano da regulação transversal, a par de uma caracterização geral do direito comunitário, tendo por base o Tratado de Roma, de 1957, é examinada, no plano nacional, e na sequência da Lei n.º 18/2003, de 11 de Junho, e do Decreto-Lei n.º 10/2003, de 18 de Janeiro, a Autoridade da Concorrência (A.d.C.), enquanto organismo regulador que tem como funções prioritárias, em articulação com as demais entidades reguladoras sectoriais, assegurar o respeito das regras de concorrência pelos operadores económicos e promover uma verdadeira cultura da concorrência em Portugal. Aflorados os consecutivos conceitos de administração, gestão e serviço públicos que, desde o século XIX, reflectiram, sob diversas influências, as diferentes formas de poder do Estado sobre a sociedade na Europa, examinado o posicionamento do Estado na sociedade portuguesa no decorrer dos séculos XX e XXI, com relevo para as sucessivas revisões constitucionais que, gradualmente, foram moldando o Estado e a Administração Pública portuguesas, propomos uma análise aos níveis de concorrencialidade existentes em cada um dos sectores em apreço, bem como perspectivamos algumas medidas tendentes à elevação dos índices de concorrência nos respectivos mercados.
The present masters degree dissertation is directed, at European and National levels, to the regulation of the infrastructural public services sector regulation, as well as to the anti-trust regulation. Water and solid waste, railway transport, telecommunications/electronic communications and the energy sectors will be characterised in this context. Therefore, the Institute for the Regulation of Water and Solid Waste (I.R.A.R.), the newly formed Institute for the Coordination of Inland Transport (I.M.T.T.,IP.), which integrates the Railway Regulatory Unit (U.R.F.), will be analised; this study will be extended to the I.C.P. - National Communications Authority (I.C.P.-ANACOM) and to the Energy Services Regulatory Authority (E.R.S.E.). At the anti-trust regulation level, side by side with a general overview of the Community Law based on the 1957 Treaty of Rome and bearing in mind the Law from the 11th June and the Decree of Law 10/2003 from the 18th January, the Portuguese Competition Authority will be examined as an organism that, in coordination with the relevant sector regulators, has, as prior tasks, to ensure the respect for the competition rules by the economic operators and also to promote a true culture of competition in Portugal. Once analised the successive public administration, public management and public services concepts that, since the 19th century, have reflected in Europe the different forms of the power of the State over society; once examined the position of the State in the Portuguese society throughout the 20th and 21st centuries and bearing in mind the relevance of the successive constitutional revisions which have gradually been moulding the Portuguese State and Public Administration, it will be proposed an analysis to the present levels of competition in each of the above mentioned regulated sectors, and some of the measures towards the increase of the competition standards in the respective markets will be put in perspective.
