O regime jurídico especial das sociedades de advogados: a problemática em torno das sociedades multidisciplinares

Abstract

Nesta dissertação abordamos a temática do exercício da advocacia à luz da problemática das sociedades multidisciplinares. A Lei n. º 2/2013, de 10 de janeiro, veio estabelecer o regime jurídico de criação, organização e funcionamento das associações públicas profissionais (LAAP) e permitir a criação de sociedades multidisciplinares, colocando ao dispor dos profissionais inscritos em ordens profissionais a possibilidade de constituírem e integrarem sociedades desta natureza. No entanto, o novo Estatuto da Ordem dos Advogados aprovado pela Lei n.º 145/2015 de 9 de setembro em conformidade com a LAAP veio estabelecer restrições e reiterar a proibição das sociedades multidisciplinares. Iremos fazer o enquadramento da evolução do regime jurídico português à luz da problemática das sociedades multidisciplinares e entender o porquê da sua rejeição no âmbito da advocacia. Será feito o panorama geral das sociedades multidisciplinares no direito europeu e dentro deste optámos por analisar especificamente o regime jurídico francês e espanhol, onde estas sociedades multidisciplinares são permitidas, procurando entender o que levou à sua adoção nestes países e em que medida são admitidas. Por fim, faremos a análise da multidisciplinaridade em função dos regimes jurídicos estudados, analisando os paralelismos entre regimes, bem como os argumentos contra e a favor das sociedades de advogados multidisciplinares.

In this dissertation is approached the theme of the practice of advocacy in the light of the issue of multidisciplinary societies. The Law No. 2/2013, of 10 January, established the legal framework for the creation, organization and operation of professional public associations (LAAP) allow the constitution of multidisciplinary societies, making it available to the professionals, registered on their professional associations setting up and integrating societies of this nature. However the Statute of the Bar Association approved by the Law no. 145/2015 of 9 September in accordance with the LAAP forbade these multidisciplinary firms. We will do the framework of the evolution of the Portuguese legal system taking into consideration the problems of multidisciplinary companies and trying to understand why they were rejected in the context of advocacy. We will analyse the general panorama of multidisciplinary companies in the European law and specifically the French and Spanish legal regime where these companies are allowed and we will try to understand what has led to their adoption in these countries and the extension of their admission. Finally, we will analyse the multidisciplinarity foucused on the legal systems we studied and analise parallels between those legal systems as well as the arguments against and in favour of multidisciplinary law firms.
