Resumo: | O crescimento exponencial do Turismo fomentou a proliferação do Alojamento Local
(AL), tanto em Lisboa como um pouco por todas as grandes cidades europeias. Nos
últimos anos, enquanto caminhava no sentido da profissionalização, este fenómeno
tomou proporções, consideradas por muitos, insustentáveis para a estrutura urbana e
social da capital. Naturalmente, controlar e mitigar as externalidades negativas do
alojamento local tornou-se impreterível. Em outubro de 2018 entrou em vigor a nova
regulamentação ao AL, com o principal objetivo de defender a cidade das externalidades
negativas que advêm da atividade, particularmente no stock de habitação existente e na
qualidade de vida dos residentes. Neste sentido, o presente estudo propôs a análise das
percepções de alguns actores do Mercado Imobiliário (MI) e do AL dos impactos
resultantes da adoção da ‘Nova Lei do Alojamento Local’, nos diversos segmentos que
constituem ambos os mercados. Assim sendo, a aplicação de instrumentos de análise
qualitativa bibliograficamente fundamentados permitiu apurar as percepções de que: (1)
os principais actores da oferta do MI e do AL estão, de forma geral, descontentes com a
regulamentação, apesar de considerarem que uma lei de ‘contenção’ era essencial ao
ecossistema do turismo e do AL na cidade de Lisboa; (2) a lei foi benéfica para a atividade
de AL pois permitiu uma estabilização da forte concorrência que existia e uma
valorização da oferta; (3) fruto desta legislação, resultou um forte impacto negativo no
MI, o que se traduz, para as empresas que operam em ambos os mercados, numa forte
redução de procura. Face a estas conclusões, espera-se que a presente análise contribua
de forma relevante para a base teórica existente na regulamentação do AL, um tema de
extrema atualidade e que revela, pelo menos para já, alguma carência de investigação
académica. The exponential growth of tourism has fostered the proliferation of Short Term Rentals (STR), both in Lisbon and throughout the major European cities. In recent years, while moving towards professionalization, this phenomenon has taken on proportions considered by many to be unsustainable for the urban and social structure of the capital. Of course, controlling and mitigating the negative externalities of local housing became, at some point, imperative. In October 2018, the new STR Regulation came into force, with the main goal of defending the city from the negative externalities of the activity, particularly in the existing housing stock and in the residents' quality of life. In this regard, the present study analyzed the perceptions of some actors of the Real Estate Market and STR Market on the impacts resulting from the adoption of the ‘New Short Term Rentals Law’, in the different segments that constitute both markets. Thus, the application of bibliographically grounded qualitative analysis tools led to the perception that: (1) the main players in the offer of the Real Estate Market and STR are generally unsatisfied with the regulation of the Short Term Rentals activity, although both agree that a 'containment' law was essential to the tourism and STR ecosystem in the city of Lisbon; (2) the law was beneficial to STR activity as it promoted a stabilization of the strong market competition and an appreciation of the supply; (3) As a result of this legislation there was a strong negative impact on Real Estate Market, which translates into a strong reduction in demand for companies operating in both markets. Given these conclusions, it is expected that this analysis will contribute significantly to the existing theoretical basis in STR regulation, a topic of extreme relevance and that reveals, at least for now, a lack of academic research. |
