Mudanças nos contratos atípicos em Portugal (2003-2014): Caso de emulação incompleta da política europeia para a flexisegurança

Abstract

O presente trabalho pretende contribuir para a compreensão dos processos de Policy Transfer. Num contexto cada vez mais globalizado, estruturas transnacionais como a UE têm promovido uma maior aproximação e convergência entre Estados-Membros. A europeização é um processo complexo de transferência e difusão que tem contribuído para o crescimento da policy transfer e vice-versa, contribuindo cada vez mais para o desenvolvimento das políticas públicas nacionais. Baseado no estudo da transferência do modelo europeu da flexisegurança pretende-se observar a evolução legislativa dos vínculos laborais atípicos em Portugal, procurando-se compreender se esta evolução correspondeu ou não ao modelo europeu de flexisegurança. Partindo deste contexto a questão de investigação é a seguinte “perceber as mudanças nos contratos atípicos em Portugal (2003-2014) – o caso da emulação incompleta da política europeia da flexisegurança”, para responder à questão foram analisadas as dinâmicas da transferência do modelo europeu da flexisegurança, nomeadamente, da sua primeira componente em Portugal. Os objetivos centrais deste trabalho são: (1) conceptualização da evolução dos contratos atípicos como um fenómeno de policy transfer; (2) entender o sucesso ou não deste processo de transferência política de acordo com o modelo a transferir (flexisegurança); (3) observar se a emulação da primeira componente da flexisegurança foi total ou incompleta. Como principais conclusões é possível identificar: 1º as mudanças legislativas referentes aos contratos atípicos fazem parte de um processo de policy transfer dividido em dois momentos distintos. O primeiro período (2003-2011) é caracterizado pela transferência voluntária correspondente ao processo de europeização enquanto o segundo período (2011 e 2014) é caracterizado pelo seu carácter coercivo devido ao MoU imposto em Portugal; 2º a evolução da política europeu da flexisegurança no segundo período assinalado e as suas alterações na agenda europeu referente a este tema; 3º e último é concluído que a transferência da flexisegurança referente à sua primeira componente foi alvo de uma mudança programática o que veio por em causa o sucesso desta transferência. Este período foi fortemente marcado por medidas que vieram aumentar a flexibilidade e diminuir a segurança o que veio contrariar o planeamento inicial da CE e proporcionar o aumento de situações precárias em Portugal e não situações flexíveis e seguras.

This paper aims to contribute to the understanding of Policy Transfer processes. In an increasingly globalized context, transnational structures such as the EU have promoted closer alignment and convergence between Member States. Europeanisation is a complex process of transference and diffusion that has contributed to the growth of the policy transfer, contributing more and more to the development of national public policies. Based on the study of the transfer of the European model of flexicurity, it is intended to observe the legislative evolution of the atypical labor ties in Portugal, seeking to understand whether this development corresponded or not to the European flexicurity model. From this context, the research question is "to perceive the changes in atypical contracts in Portugal (2003-2014) - the case of incomplete emulation of the European policy of flexicurity", to answer the question analyzed the dynamics of the transfer of the European model flexicurity, namely its first component in Portugal. The main objectives of this work are: (1) conceptualization of the evolution of atypical contracts as a phenomenon of policy transfer; (2) understand the success or otherwise of this process of political transfer according to the model to be transferred (flexicurity); (3) observe whether the emulation of the first component of flexicurity was wholly or incompletely. As main conclusions it is possible to identify: 1st the legislative changes regarding the atypical contracts introduced in a process of policy transfer divided in two distinct moments. The first period (2003-2011) is characterized by the voluntary transfer corresponding to the process of Europeanization while the second period (2011 and 2014) is characterized by its coercive character due to the MoU imposed in Portugal; 2 ° To understand the evolution of the European flexicurity policy in the second period and its changes in the European agenda on this subject; 3 and finally, it is concluded that the transfer of flexicurity related to its first component was the subject of a programmatic change, which was due to the success of this transference. This period was strongly marked by measures that increased flexibility and decreased security, which was contrary to the initial planning of the EC and to provide for the increase of precarious situations in Portugal and not flexible and safe situations.
