Resumo: | A Autoridade Marítima é uma política pública que foi sempre dirigida por oficiais da
Armada em comissões temporárias, usufruindo de benefícios pecuniários, poder e
prestígio adicionais. Desde 1982, a Constituição estabelece que as Forças Armadas
não têm competências domésticas próprias; mas a Armada continuou a dominar a
Autoridade Marítima. Até 2002 esteve mesmo integrada na Armada. Com a criação
da Autoridade Marítima Nacional em 2002, definiu-se uma separação formal, mas a
Direção-Geral da Autoridade Marítima e a Polícia Marítima continuam a ser, também
financeiramente, dirigidas pelo Chefe do Estado-Maior da Armada, contrariando as
normas da Constituição que afastaram as Forças Armadas dos cenários domésticos.
Este artigo analisa estas situações à luz da public choice e dos três neoinstitucionalismos,
concluindo que a primeira e o histórico entre as seguintes
oferecem a melhor interpretação dos factos. The Maritime Authority is a public policy that has always been managed by Navy officers on temporary tours of duty, with additional pecuniary benefits, power and prestige. Since 1982, the Portuguese Constitution establishes that the Armed Forces do not have domestic powers of their own; but the Navy kept on dominating the Maritime Authority. Up to 2002 it was even integrated in the Navy. With the creation of the National Maritime Authority in 2002, a formal separation between the two was established, but the Directorate General of the Maritime Authority and the Maritime Police kept on being managed, also financially, by the Head of the Navy, against the constitutional norms that moved the Armed Forces away from domestic sets. This paper studies these situations under the methods proposed by the public choice and the three new institutionalisms, and concludes that the first and the historic among the next ones offer the best interpretation of the facts. |
