Teorias sociais face ao Direito

Abstract

Em polémica com Pierre Guibentif, procura mostrar-se a diferença entre usar a sociologia no campo do direito e aliar a sociologia ao direito, do ponto de vista do futuro da sociologia. Utilizam-se as conclusões do autor citado para apresentar e defender as perspectivas abertas pela sociologia da instabilidade com vista a uma maior clarificação do âmbito científico próprio da sociologia e para, desse modo, clarificar também as oportunidades de trabalho interdisciplinar com as ciências dogmáticas. Defende-se a perspectiva ideológica de revalorizar a igualdade e o sujeito portador de direitos como a mais interessada e adequada a esta estratégia epistemológica.

Polemizing with Pierre Guibentif, the paper shows the difference between using sociology in order to analyze the social field where the Law is done and using sociology to join the social questioning produced whenever the Law is at work. Pierre Guibentif conclusions are used to present and support sociology of instability main principles as a way to make clearer the boundaries of the cognitive field of sociology and the advantage of cooperating with dogmatic sciences in order to go further on the reasoning about practical human problems. The ideological perspective of supporting equality, as a social and civilization value, seems to be the more interesting and adequate perspective to support the epistemological perspective that enhance the individual as a social agency.
