Reconfiguração do modelo de proteção à criança, promovido pela Lei 142-2015, de 8 de setembro

Abstract

Este trabalho resulta de uma pesquisa em Serviço Social sobre a reconfiguração do modelo de proteção à criança promovido pela Lei de Proteção de Crianças e Jovens em Perigo (LPCJP), atual Lei 142/2015, de 8 de setembro. Aborda a questão da criança enquanto ser de pleno direito na promoção de autonomia, cidadania, participação e igualdade de oportunidades. Assim, procuramos desenvolver um processo de análise e compreensão sobre as alterações produzidas pela reforma da reforma legislativa na melhoria do bem-estar da criança. No decurso da parte empírica, abordam-se questões sobre a temática da infância, ao nível do reconhecimento dos direitos das crianças e do enquadramento legal no que respeita à sua evolução histórica e atualidade. O contributo da Convenção dos Direitos da Criança, em 1989, deu maior visibilidade à questão da prevenção e proteção da criança considerando o seu superior interesse. À luz da LPCJP, foi realizada uma análise comparativa entre as Lei 147/99 e 142/2015, reconhecendo-se uma maior clarificação dos seus conceitos e modos de atuação dos profissionais em matéria de infância e juventude. No campo de atuação dos Assistentes Sociais, pelas especificidades da profissão, estes assumem-se como profissionais fundamentais na identificação de fatores de risco e perigo junto de crianças e jovens em situação de desproteção, pelo que, ao longo da pesquisa, são sistematizadas as novas orientações para uma intervenção social territorializada no domínio do Serviço Social.

This work is the result of research in the field of Social Services as regards to the restructuring of the child protection model established by the Law for Protecting Children and Young People at Risk (LPCJP), Law 142/2015 of 8 September currently in force. It addresses the issue of the child as a being with rights of autonomy, citizenship, participation and equal opportunities. The intention is to develop a process of analysis and understanding as regards to the changes resulting from the legislative reform aimed at improving children’s well-being. In the empirical section, the childhood theme is explored in the context of the recognition of children’s rights and the legal framework reflecting the accompanying historical and current developments. The Children’s Rights Convention in 1989 gave greater visibility to the issue of prevention and child protection considering their best interests. In light of the LPCJP, a comparative analysis of Law 147/99 and Law 142/2015 was carried out in recognition of the need for further clarification of the concepts and operation of professionals in the field of childhood and youth. In the field of activity of Social Workers, due to the specificities of the profession, they are considered to be key professionals in the identification of risk factors and danger faced by children and young people in vulnerable situations. Accordingly, this work systematises new guidelines for territorialised social intervention in the field of Social Work.
