Regulação económica do setor elétrico: O caso da baixa tensão em Portugal continental

Abstract

Desde a súbita nacionalização em 1976, o setor elétrico português tem sido progressivamente privatizado e liberalizado. Dando cumprimento a diretivas europeias, os últimos vinte e cinco anos foram prolíferos em alterações estruturais. O monopólio natural verticalmente integrado deu lugar à separação de atividades cuja exploração foi concedida a privados. A estrutura atual do setor encontra-se dividida entre segmentos concorrenciais e segmentos de monopólio natural explorados sob a supervisão de regulação setorial independente. A Lei n.º 31/2017 acarreta novas alterações que representam desafios acrescidos ao segmento da distribuição de eletricidade em baixa tensão, prenunciando um novo modelo de concessões. A partir de um problema de programação linear inteira, é proposto um modelo de concessões alternativo à proposta do regulador, com base no qual se pretende aferir se a introdução de concorrência é possível e desejável em segmentos tradicionalmente não concorrenciais. Questiona-se se o redimensionamento da atividade implícito num modelo de concessões múltiplas compromete a manutenção de economias de escala e se a promoção da concorrência pelo mercado pode atrair novos players com capacidade de competir em leilão pela concessão do serviço a preços competitivos. Porém, esse modelo adensa as dúvidas: estarão as empresas potencialmente entrantes no mercado tecnicamente preparadas? Como se relacionarão com os restantes intervenientes do setor? Nesse sentido, aprofundam-se as razões da intervenção do Estado nas public utilities com enfoque nas teorias do monopólio natural e na regulação económica, exploram-se as possíveis estruturas industriais do setor elétrico e reflete-se acerca dos futuros desafios que se lhe colocarão.

Since its sudden nationalization in 1976, the portuguese electricity sector has been facing a progressively privatization and liberalization process. Due to EU directives, the last twenty-five years have been prolific in structural changes. The vertically integrated natural monopoly gave way to the split of activities whose exploration was then conceded to the private sector. Currently, the sector’s structure is divided between competing and natural monopoly segments, under the supervision of the regulatory authority. Law 31/2017 brings new challenges to the low-voltage distribution sector, anticipating the need for a new concessions model. Using an integer linear programming problem, the purpose of this work is to find an alternative design to the regulator’s model of concession, based upon whether competition is possible, or even desirable, in traditionally non-competitive sectors. It questions if the implied activity downsizing based on a multiple-concessions model will jeopardize the current economies of scale and if promoting increased competition for the market can attract powerful players to bid for the concessions, while still offering the service at a competitive price. However, that model raises more questions: will those new market participants be technically well prepared? How will they interact with the other players? Therefore, in the light of the natural monopoly theory and economic regulation, the reasons behind state intervention in public utilities will be thoroughly analysed, the possible options for the industrial framework of the electricity sector will be discussed and what might the challenges ahead bring with them will be questioned.
