Resumo: | Com este trabalho pretendeu-se estudar a estreita ligação entre o direito da concorrência
e o sector da distribuição moderna em Portugal, tentando compreender a conformidade
dos comportamentos dos grandes distribuidores face ao ordenamento jurídico
concorrencial.
Para o efeito recorreu-se à análise do regime jurídico europeu plasmado nos arts. 101.º -práticas colusivas – e 102.º – abuso de posição dominante – do Tratado de
Funcionamento da União Europeia e à Lei da Concorrência, cujo regime jurídico foi
transposto pela Lei n.º 19/2012, não descurando o histórico da Jurisprudência Europeia
bem como as várias comunicações interpretativas emanadas pela Comissão.
Reservámos também parte do nosso estudo ao regime das Práticas Individuais
Restritivas do Comércio, reguladas pelo Decreto-Lei 166/2013 e à figura dos contratos
de fornecimento, os quais usualmente regulam as relações contratuais entre
fornecedores e distribuidores.
Concluímos por uma diminuta intervenção da Autoridade da Concorrência no sector da
grande distribuição em Portugal, o que se justifica pela quase inexistência de práticas
que devam ser consideradas anti-concorrenciais, o que não quererá dizer que o
desequilíbrio entre as partes não seja notório. This work aims to study the close link between competition law and the modern distribution sector in Portugal, trying to understand the compliance of the behavior of the big distributors before the competitive law. For this purpose we proceed to the analysis of the European legal system fixed in articles 101 - collusive practices - and 102 - Abuse of dominant position - of the Treaty on the Functioning of the European Union, and of the National Competition Law, which was implemented by Law No. 19/2012; also not forgetting the jurisprudence of the European Court as well as the various interpretative communications published by the Commission. We also have reserved part of our study to the system of Restrictive Practices of the Commerce, regulated in Portugal by the Decree-Law 166/2013 and finished with the analysis of the figure of supply contracts, which usually regulate the contractual relations between suppliers and distributors. We concluded by a very little intervention of the Natonal Competition Authority in the large retail sector in Portugal, which is justified by the almost nonexistence of practices that should be considered anti-competitive, which will not mean that the disequilibrium between the parties is not quite noticeable. |
