A organização do sistema judicial enquanto condicionante da realização do Direito

Abstract

Através desta investigação procura-se salientar a importância que tem a organização e o modus operandi do sistema judicial para a realização do direito e, pela via da investigação, contribuir para a obtenção de um sentido mais enriquecido da noção de jurisdição. Questionando, em virtude do que resulta da actividade judiciária, se as condições de realização da tarefa jurisdicional, mais precisamente as questões organizativas da justiça, influenciam a forma de ver e pensar a própria jurisdição e, por aí, o sentido da realização jurisdicional do direito. Procurando delinear, através dessa mesma questão, um quadro de articulação das múltiplas e distintas abordagens sobre a actividade e o desempenho do sistema judicial, sobretudo ao nível das condições práticas de realização jurisdicional do direito. Colocando a possibilidade de encontrar, a propósito desse tema, um discurso conciliador dessas visões multiformes e multidisciplinares sobre o sistema judicial, e projectando, dessa forma, num quadro unitário e mais consistente, as três dimensões básicas da realidade judiciária. Uma análise que, por essa via, possibilitará a clarificação do que muito de disperso e por vezes contraditório se tem dito sobre a “reforma da justiça”. Dando conta do estado actual da experiência comparada e das múltiplas abordagens de que tem sido objecto a organização dos sistemas de justiça nestes últimos tempos. Apelando, em conjunto, para a necessidade de novas sínteses sobre a questão da operacionalidade do sistema judicial e do valor essencial que tem, para essa discussão, a tarefa de realização e aplicação do direito.

The intention of this research is to ascertain the importance which the organisation and the modus operandi of the judicial system have for the adjudication and, by means of research, to contribute to the richer meaning of the concept of jurisdiction. It is questioned, in virtue of the results of the judicial activity, whether the conditions of fulfilment of the jurisdictional task and, more precisely the organisational issues of justice, influence the way in which jurisdiction itself is viewed and, accordingly, the concept of adjudication. An outline is sought, through the same issue, of a framework of articulation of the multiple and distinct approaches to the activity and the performance of the judicial system, above all with respect to the practical conditions of jurisdictional fulfilment of the law. The possibility is raised of finding, in respect of this issue, a conciliatory discourse covering these multifaceted and multi-disciplinary views of the judicial system, and thereby of setting out, in a unifying and more consistent framework, the three basic dimensions of the judicial reality. Such an analysis will, by this means, enable the clarification of what has been said, from a wide range of standpoints and sometimes contradictorily, on “justice reform”. Account is given of the current state of compared experience and of the multiple approaches in respect of that which the organisation of the justice systems has been subjected to over recent years. At the same time, there is a call for the need for a set of new syntheses on the question of the operational functioning of the judicial system and the essential value which it has for this discussion and the task of adjudication.
