A participação do acidente de trabalho e o inicio do processo judicial

Abstract

A presente dissertação insere-se na temática do regime jurídico dos Acidentes de Trabalho constante na Lei 98/2009, de 4 de setembro (LAT), e do seu controlo jurisdicional que se fundamenta no Código de Processo do Trabalho (CPT). Para um breve entendimento, esta dissertação conterá uma sinopse acerca da noção e do regime dos acidentes de trabalho e a sua relação com o contrato de trabalho. O objetivo primordial será o estudo das formas que a participação do acidente de trabalho pode assumir para originar o processo especial para efetivação de direitos resultantes de acidentes de trabalho, tendo em consideração as entidades obrigadas a fazer a comunicação e os mecanismos processuais das diferentes participações a serem desenvolvidos pelo Ministério Público. Por outro lado, pretende-se definir já no âmbito do processo especial emergente de acidentes de trabalho, os termos em que este se estabelece e qual o tribunal competente para receber a participação e para promover a respetiva ação judicial e o mérito desta.

This thesis has as background theme the Work Accidents Law (WAL) of the Legal Framework, as seen in 98/2009 law of 4 September,and your jurisdictional control founded on Work Process Code (WPC). For a brief understanding, in this dissertation there is a synopsis concerning the notion and the regime of the work accidents and their relation with the employment contract. The fundamental aim will be studing in which ways reporting an work accident can influence in the origin of the special process for the establishment of the rights resuting from that work accident, always considering the entities which own the duty to perpetuate the communication and the developments concerning the different reports to be prosecuted by the public prosecution service. On other side, it is also pertinent to define the therms for the special process emerging of work accident where is estabished which is the most competent court able to receive the report and to promote the respective legal action and his merit.
