Terrorismo e direitos humanos: O caso do Reino Unido

Abstract

Desde os ataques terroristas de 11 de Setembro, nos Estados Unidos, vários países ocidentais adoptaram novas estratégias antiterroristas rígidas que colocam em causa os direitos humanos dos seus cidadãos. O Reino Unido, ajudado pela sua extensa experiência com o terrorismo doméstico, liderou esta nova retórica antiterrorista implementando várias medidas antiterroristas que colocavam em causa os princípios salvaguardados pela Convenção Europeia dos Direitos Humanos, que estavam incorporados na legislação britânica através do Human Rights Act. Depois dos ataques terroristas de 7 de Julho de 2005, em Londres, o governo britânico implementou uma estratégia antiterrorista ainda mais punitiva e adoptou uma atitude implacável para prevenir potenciais ataques terroristas, concedendo mais poderes excepcionais à polícia e incorporando medidas antiterroristas que afectavam o cidadão comum. A presente dissertação foca-se na análise do impacto das medidas antiterroristas implementadas depois dos ataques terroristas de 7 de Julho de 2005 nos direitos humanos dos cidadãos britânicos, seguindo os princípios da Convenção Europeia dos Direitos Humanos.

Since the 9/11 terrorists attacks, in the United States, various western countries adopted new strict antiterrorists strategies that undermine their citizens’ human rights. The United Kingdom, helped by its extensive experience with domestic terrorism, led this new antiterrorist rhetoric by implementing some antiterrorist measures that undermined the principles protected by the European Convention on Human Rights, which are incorporated in the British legislation through the Human Rights Act. After the terrorist attacks of 7 July 2005, in London, the British government implemented an antiterrorist strategy even more punitive and adopted a relentless attitude in order to prevent potential terrorist attacks, granting more exceptional powers to the police and incorporating antiterrorist measures which affected the common citizen. This dissertation focus on the analysis of the impact of the antiterrorist measures implemented after the terrorist attacks of 7/7 in the British citizens’ human rights, following the principles of the European Convention on Human Rights.
